Jugl Privacy Policy

Our Commitment to Your Family’s Privacy

We are committed to protecting your family’s privacy when you use Jugl. We take this commitment seriously and have built Jugl with privacy and security in mind from the ground-up. And we want to be transparent with you about the types of information we collect and how we use it to provide services to you. We value your trust, and want you to be assured that we have taken steps to develop and operate Jugl as a safe environment for your family to communicate and plan. This privacy policy explains how we collect and use information about families on the platform.

Information About Children

We intend Jugl to be directed at busy working parents and guardians but acknowledge that children will use the service as well – after all, the point of Jugl is to make scheduling easier for entire families. Here is the essential point about children’s information: We will never knowingly or intentionally gather personally identifiable information (e.g., name, address, phone number, email address) directly from anyone under the age of 13 without the consent and oversight of a responsible parent, guardian or other responsible adult associated with the account.

We have designed Jugl to require users setting up an account to be at least 18 years old. This means families who use Jugl will be doing so with adults in the family overseeing how the platform is being used, and adults being responsible for providing personally identifiable information about others in the family. If someone under 13 provides information to us, the authorized adult(s) in the family using Jugl will see that and will be able to delete or modify the information.

Information We Collect

When you use Jugl, we will collect your name, email address, phone number, and location information from your device (if you have those settings enabled). If you make purchases through the services, we also collect your payment information, which may include your credit card or debit card number. We use this information to enable you to use and pay for the service, for us to perform internal operations such as fraud prevention, and to send communications that may be of interest to you, and otherwise personalize the services you receive.

In addition, we collect the IP address of your computer used to access Jugl, and third-party services which we utilize in connection with the service, such as Google Analytics and HubSpot may also collect, monitor and analyze, along with non-personally identifiable information, your IP address and related information in order to increase the service’s functionality.

These third-parties may use cookies and/or web beacons to help us analyze how our users are using Jugl and they have their own Privacy Policies addressing how they use such information.

Google Analytics. Google Analytics service is provided by Google Inc. You can opt-out from Google Analytics service from using your information by installing the Google Analytics Opt-out Browser tool: https://tools.google.com/dlpage/gaoptout. HubSpot. HubSpot is provided by HubSpot, Inc. HubSpot’s privacy policy, including opt-out information, is available at: http://legal.hubspot.com/privacy-policy/.

Security

We use industry-standard methods of securing user information and data. Examples of our security measures include, where appropriate, firewalls and secure socket layers. We also maintain strict limits on who at Jugl can access the information databases that contain your information. Because there is no such thing as perfect security over the internet, we cannot guarantee 100% security. In the unlikely case of a security breach of our databases, we will take prompt steps to resolve the problem.

Parties With Whom We Share Your Information

Unless we have your express consent, we do not share your information with any third parties, except as explained in this section.

We use certain trusted third parties to help us provide, personalize, improve, offer and protect our services. These third parties will access your information only to perform tasks on our behalf. For example, we use Amazon Web Services as our third-party hosting provider. AWS provides services in accordance with its privacy policy which is found here: https://aws.amazon.com/privacy. We also use a third party called zMailCloud to assist with certain back-end data functions. zMailCloud provides its services in accordance with its privacy policy found here: https://zmailcloud.com/privacy-policy/.

We may need to disclose information about you and the members of your family who use Jugl to third parties if we have a good faith belief that we are required to do so by law or legal process, to respond to legal claims, or to protect the rights, property, or safety of our company or others.

We may disclose information about you and the members of your family who use Jugl to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale or disposition of all or a portion of our company’s assets. The successor organization’s use and disclosure of your information will continue to be subject to this privacy policy unless (i) a court orders otherwise, for example, a bankruptcy court; or (ii) the successor organization gives you notice that your information will be subject to the successor organization’s own privacy policy, along with an opportunity for you to opt out (which may cause you not to be able to continue to use Jugl). If you submit information after such a transfer, that information may be subject to the successor entity’s privacy policy.

Reviewing and Requesting Changes to Your Information

You can delete or modify information about you and members of your family using the platform’s account management features. After you delete information from your account, we likewise delete it within a reasonable time thereafter unless there are legal requirements (such as a court order or law) that cause us to retain it.

Changes to this Privacy Policy

We may change this privacy policy from time to time. If we make significant changes in the way we treat your personal information, or to the privacy policy, we will provide you notice through Jugl or by some other means, such as email. Your continued use of the services after such notice constitutes your consent to the changes. We encourage you to periodically review this privacy policy for the latest information on our privacy practices.

Do Not Track

We do not track users over time and across third-party websites to provide targeted advertising and therefore do not respond to “do not track” signals. Third parties that have content embedded within the service such as a social feature may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited a specific location from a certain IP address. Third parties cannot collect any other personally identifiable information from the service unless you provide it to them directly.

Your California Privacy Rights

California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes. We do not share your personally identifiable information with third parties for the third parties’ direct marketing purposes unless you provide us with consent to do so.

Information About GDPR Compliance

Certain data provided by you through the use of the Site may be governed by the General Data Protection Regulation (“GDPR”).  The following information concerns compliance with this new regulation.

Effective Date of GDPR

GDPR came into effect on May 25, 2018.  On and after that date, we will comply with GDPR to the extent applicable.

Bases for the Processing of Data

Where you have entered into an agreement with us, purchased a service from us, or downloaded any app, we may require this data as a condition of the contract between you and us (https://www.getjugl.com/terms-of-use).   In other circumstances, we may process data because we have a legitimate interest in marketing or apprising you of offers or services, or because you have consented to receive such offers and services.

Your Rights Under GDPR

If the GDPR applies to retention of your personal data, you have several rights including (i) the right to request access, rectification or erasure of your data, (ii) the right to lodge a complaint with the appropriate European Union supervisory authority, and (iii) to the extent processing of data is based on consent, you have the right to withdraw your consent at any time.

Consent and Withdrawal

To the extent we seek your consent for the processing of Personal Data, you may withdraw your consent at any time by clicking unsubscribe or contacting us at [email protected].

Jurisdiction and Cross-Border Transfer

Personal Data may be stored and processed in any country where we have facilities or in which we engage service providers, including the United States, and by using the Services you understand that your information will be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies or regulatory agencies in those countries may be entitled to access personal data.

Safeguarding Personal Data

All employees of Jugl who receive or review personal data have received training concerning maintaining the confidentiality of such data and committed themselves to confidentiality. Where appropriate, we will enter into written agreements governing the processing and confidentiality of personal data by third parties.

Storage of Data

We will retain personal data for as long as it is needed or permitted in light of the purposes for which it was obtained. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you; (ii) whether there is a legal obligation to which we are subject; and (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

Additional Information Regarding the EEA
